Carroll To Rohn On Accelerated Restraining Order: Denied!
Atty. Lee Rohn’s “ex parte” request for a restraining order against CruciansInFocus.com, DemManSay.com and several individuals has been denied by Virgin Islands Superior Court Judge James Carroll III.
On July 23, Rohn filed an action in Virgin Islands Superior Court for “Slander and Defamation” against the aforementioned websites; CIF President Michael Springer; Atty. Jeffrey Moorhead; Former Senator Adelbert Bryan; Claude Gerard; Edwin Callwood; Dwayne Callwood; and “John Does.”
Rohn in her filing says her suit is “based on the fact that Defendants have repeatedly published false, defamatory, libelous statements concerning Rohn; and that the actions of the Defendants “have and will continue to ruin Plaintiff’s reputation in the community.”

She then filed for a temporary restraining order “ex parte” – which means that she was seeking to have it executed with no notice to the Defendants – based, she wrote, on her belief that she would suffer “further immediate and irreparable injury, loss or damage” by the alleged actions of the Defendants without an immediate order to restrain the named activities. Those activities included, but were not limited to, the publishing of any further information Plaintiff deemed false as well as access to and seizure of equipment used in the preparation and publishing of the named websites.
Carroll, in denying the request on August 3, stated that Rohn had failed to demonstrate the “existence of irreparable harm, the absence of an adequate and speedy remedy at law, the probability of ultimate success on the merits, and that the threat of harm to the defendant outweighs the threat of harm to the opposing party.”
Further, Carroll wrote, “no affidavit is submitted in support of the application and nether the application or the complaint is verified. Nor has Petitioner certified in writing any efforts made to give notice to the adverse parties and why notice should not be required.”
Therefore, he concluded, “Petitioners statements on information and belief are insufficient to support the issuance of a temporary restraining order without notice for the adverse parties” and the application for the Temporary Restraining Order, Writ of Seizure and Order to Show Cause were denied.
Carroll acted on the request in the absence of Judge Darryl Dean Donohue, who has been assigned to the case.
Crucians In Focus has its own theories on the purpose and timing of this action. However, we shall decline any further comment at this time as the matter is “pending litigation.”

I don’t know what your theories are but I’ll give you mine. The same people are behind this (funding it) as tried to get Mario off the radio; as tried to destroy the equipment at 1620; as tried to frame Donastorg – anybody see a pattern here?
I read all the documents – they are poorly written and look like the ravings of a madwoman.
CIF don’t lose “focus.” This is just another distraction. Stay the course – we need you.
They are very busy and determined whoever they are. Can the people really overcome such power and determination. We as a people are easily distracted and duped. I don’t want to offend but the first step in overcoming a problem is to admit that there is a problem, then and only then can it be addressed or corrected. No one will fix it for us they will fix it for them.
Read the lawsuit re ‘Action For Slander and Defamation’ and found it to be most interesting.Plaintiff sure had a lot to complain about.
Will have to ‘keep an eye out’ as to how this all plays out.
