New “Oversight” In PFA Inquiries

Revised minutes say Christian was not at October, 2009 PFA Meeting: Christian Issues Statement

It is the second significant “oversight” this week.

According to a letter issued today from the court reporter, the meeting minutes that listed Superior Court Judge Adam Christian in attendance at an October 6, 2009 meeting of the Virgin Islands Public Finance Authority were in error.

In a letter dated January 21, 2010, to PFA Executive Director Julito Francis, court reporter Vashti O. Gerald-Berry said, “Upon review of my written notes of attendance, it is correct that Attorney Christian was not in attendance on October 6, 2009, hence the reason for the amended title page.” Gerald-Berry is a court reporter for Theodore A. Dorsett and Associates, Registered Professional Court Reporters.

“It is evident that there was an oversight on my part in not removing Attorney Adam Christian’s name from the title page,” she wrote. (Italics added)

A copy of the letter, and the amended title page from the meeting minutes, was hand delivered today to Sen. Neville James, under a cover letter from James H. Hindels, Esq., PFA Legal Counsel, of the firm Birch, deJongh and Hindels, PLLC.  Sen. James is the chairman of the Committee on Financial Services, Infrastructure and Community Affairs and it was at a committee meeting Tuesday, which was held to investigate the “Mafoliegate” matter, that the original certified meeting minutes were released. (all documents attached at the end of this article)

Judge Christian also released a statement reiterating that he spoke truthfully when asked about his attendance at that meeting during his appearance before the Rules Committee last November.

The meeting is significant because it was during this session that the PFA ratified the appropriations of $1.3 million in reprogrammed funds in Act 6917, a bill passed by the Legislature in March, 2007.  Some $490,000 of these funds, which were authorized for road repair, was instead used to pay for renovations at Governor John P. deJongh’s private Estate Mafolie residence.

During Tuesday’s hearing, current and former members of the PFA board responded to questioning from the committee about the 30 month delay between the funds approval and their action to ratify, unanimously agreeing that the lack of action on the resolution was an “oversight” and that their decision to act on the matter in October of 2009 was a result of an inquiry by Hindels, who brought it to their attention last fall. (italics added)

In a statement released Thursday, Christian said that he had been made aware of “certain public statements which accuse me of being dishonest speceicially (sic) in my testimony before the Committee of Rules and Judiciary,” during the November 20 hearing.

With “no reservation whatsoever,” he stated, he stands by his testimony. “I did not attend the meeting of the Virgin Islands Public Finance Authority held on October 6, 2009 in St. Thomas Virgin Islands.”

Some make reference to Winston Churchil, others to the Furor, but I respectfully make reference to the likes of OmarBrown,Dr.Evans,
Cyril King,Alex Farrelly,Ruby Rouss,Elmo Roebuck and Claude Malloy…….all of whom (may the good Lord rest their weary souls)one can only imagine, are writhing in pain (and shame too) as they toss and turn in their graves. Is this, they might have asked, what we fought so hard and struggled for so long to have come to? Oh bwoy!I leave that for other minds to contemplate.

Omar Brown as in the Progressive Guide Party?

    Frenchie and St.Thomas Government Worker:
What is the court case that is pending against Ken Mapp? One thing you have to remember when you are digging a grave dig three: one for you, one for the person and one for disappointment.

There is no court case, this what we call scare tactics a republican strategy when an opponent is getting stronger, you make them suspect. The only pending court case is Mafoligate. Stupid why Ken Mapp put himself in a race when he knows he’s about to face any wrong doing. And don’t comeback by saying he don’t know, because if you know that you have done something against the law eventually it going to bite you in the a**.

William P. Mapp as you describe I know not. He is a very nice person. I work with him for a long time. He only wants productivity and accountability, which a lot of us don’t subscribe too. What’s wrong in getting people to preform, we just to laid back and expect that things will get better without some hard work.

After the disastrous Schneider and Dewolf administration’s don’t you think our politicians have gotten a wake up call and have adopted to doing better. Who did Schiender choose in his re-election bid another running mate, because he a Mapp were locking heads against his behavior and his way of dealing with things. So don’t make people feel that Mapp is the same as Schnieder.

How is it that we have “shifted” from the IG Report about deJongh to “discussion” about Mapp?

Continue with it, and deJongh may just snatch “HIS defeat from the YOUR jaws of victory.”

    yeah, I agree with WEO…

Maybe we can get some special Blog Headings where we can discuss each candidate individually…CIF?

The profound impact of the IG report is this:

It has proven that the “BANK OF JUSTICE” in the United States Virgin Islands is not yet “BANKRUPT.”

@Anonymous: Yes we can. For now we’ll work on putting up separate pages for the “known” gubernatorial candidates: deJongh, Mapp, Donastorg, Nelson. We will let you know when they are ready.

We agree that there needs to be a separate area for these discussions. Please note that general articles on this year’s election activity will be filed under the Election 2010 tab above.

    Thanks- we love the suggestions.

‘EWO’,if you are referring to the Republican Party as the ‘Progressive Guide Party’,yes. He was.

We all in this thing together. The CIF bloggers are one family. Do you expect all members to share the same opinion? We will see how balance the family is. How low will they get? Notice that the deGreat supporters are viciously attacked, but they continue to have respect for the those who oppose deGreat? This is called confidence, those with fear & uncertainty are desperately holding on to an impossible dream. It is not going to happen-he will not be recalled, driven out of office, resigned, impeached or jailed. Get a grip of reality and accept the facts. deGreat is here to stay, he can be scare away, no way!

Mapp and deJongh are both Republicans we need none of this here in the Virgin islands… Anybody but those two…. Id rather vote for deWolf over Mapp call me crazy .

  15. Anonymous on January 24, 2010 at 1:36 pm

You are incorrect. deJongh was elected as a Democrat, but lost the first time when he ran as an Independent. It is hard to beat an incumbent Democrat. Review history. That is VI History.

He(Dewolf)has already lost the race, his inability to be a commander in chief, the only thing he commands well is how to be a thief. So his ship has already set sail let’s look to the future and elected a true honest and transparent government. Since we have grown up as voters I believe we are capable of making better decisions. I want to see how well we have learn to not elect people just because they have light skin, straight hair, good looking, gives t-shirts/free food & fete` and a popular family name. Let’s start voting for someone who demonstrates that they understand government and have the ability to execute their duties with intelligence and good common sense. Let’s look for a candidate who looks out for the masses not just for a few. Soon you going to her about 5 wealthy people who are going to walk away with millions of VI government money stay tune. Dewolf plans is to leave this government broken.

You said, “It is hard to beat an incumbent Democrat. Review history. That is VI History.”

I say there has never been an incumbent Democrat who has re-directed almost a half-million dollars away from “public projects” and towards his “private residence.”

The IG just told your incumbent Democrat to “put it back!”

  19. Anonymous on January 24, 2010 at 5:21 pm

    EWO-

The IG not only told him to put it back–she asked him to tell her when he gon put it back. John Percy deJongh has been served!!!

  20. Anonymous on January 24, 2010 at 5:24 pm

    Anita,

You are crazy! You asked me to call you that!!!!! You would vote for a proven Republican thief over a plain ole Republican? You are crazy!!!
