New “Oversight” In PFA Inquiries
Revised minutes say Christian was not at October, 2009 PFA Meeting: Christian Issues Statement
It is the second significant “oversight” this week.
According to a letter issued today from the court reporter, the meeting minutes that listed Superior Court Judge Adam Christian in attendance at an October 6, 2009 meeting of the Virgin Islands Public Finance Authority were in error.
In a letter dated January 21, 2010, to PFA Executive Director Julito Francis, court reporter Vashti O. Gerald-Berry said, “Upon review of my written notes of attendance, it is correct that Attorney Christian was not in attendance on October 6, 2009, hence the reason for the amended title page.” Gerald-Berry is a court reporter for Theodore A. Dorsett and Associates, Registered Professional Court Reporters.
“It is evident that there was an oversight on my part in not removing Attorney Adam Christian’s name from the title page,” she wrote. (Italics added)
A copy of the letter, and the amended title page from the meeting minutes, was hand delivered today to Sen. Neville James, under a cover letter from James H. Hindels, Esq., PFA Legal Counsel, of the firm Birch, deJongh and Hindels, PLLC. Sen. James is the chairman of the Committee on Financial Services, Infrastructure and Community Affairs and it was at a committee meeting Tuesday, which was held to investigate the “Mafoliegate” matter, that the original certified meeting minutes were released. Judge Christian also released a statement reiterating that he spoke truthfully when asked about his attendance at that meeting during his appearance before the Rules Committee last November.
The meeting is significant because it was during this session that the PFA ratified the appropriations of $1.3 million in reprogrammed funds in Act 6917, a bill passed by the Legislature in March, 2007.  Some $490,000 of these funds, which were authorized for road repair, was instead used to pay for renovations at Governor John P. deJongh’s private Estate Mafolie residence.
During Tuesday’s hearing, current and former members of the PFA board responded to questioning from the committee about the 30 month delay between the funds approval and their action to ratify, unanimously agreeing that the lack of action on the resolution was an “oversight” and that their decision to act on the matter in October of 2009 was a result of an inquiry by Hindels, who brought it to their attention last fall. In a statement released Thursday, Christian said that he had been made aware of “certain public statements which accuse me of being dishonest speceicially (sic) in my testimony before the Committee of Rules and Judiciary,” during the November 20 hearing.
With “no reservation whatsoever,” he stated, he stands by his testimony. “I did not attend the meeting of the Virgin Islands Public Finance Authority held on October 6, 2009 in St. Thomas Virgin Islands.”
