Transcripts confirm contradictions in Christian's sworn testimony to Legislature and PFA Records

On two separate occasions, under oath, newly ascended Superior Court Judge Adam Christian told the Legislature he did not attend the now infamous October 6, 2009 meeting of the Virgin Islands Public Finance Authority (PFA) where a resolution on funds appropriated 2 1/2 years ago was belatedly completed.

Transcripts from the meeting, however, say he was there.

The meeting was significant because it was at this session that $1.3 million in reprogrammed public funds from a March, 2007 Legislative action were approved. Those funds, from Act 6917, were authorized for road repairs but some of the money, some $490,000 documented to date, paid for renovations to Governor John P. deJongh’s private Estate Mafolie residence.

CIF has obtained a copy of the relevant portion of the Rules Committe transcript showing Christian’s dual denial that he attended the PFA meeting. A certified copy of the minutes from the PFA meeting, which list Christian as a “staff” member in attendance, was released at a Tuesday night Legislative Committee hearing investigating the Mafoliegate matter. Both documents are attached at the end of this article.

Tuesday’s hearing was convened  by Senator Neville James, chairman of the Committe on Financial Services, Infrastructure and Community Affairs.

The PFA transcript also outlines the participation of the governor in the approval of the resolution containing the funds used in the renovation. The Governor is the Chairman of the PFA and several questions remain about the potential conflict of interest issues raised by the Governor signing contracts and participating in meeting transactions that enriched him personally through the unauthorized (by the Legislature) use of public funds at his private property.

The Committee had expressed a desire to question Christian during his confirmation hearings about these activities and his role in them as legal counsel to the Governor during the period between January, 2007 and the completion of the Mafolie renovation. Christian declined to answer questions from the committee during that session citing “attorney/client” privilege.

At that time, Sen. James said that he was uncomfortable with the “timing” of Christian’s nomination, coming as it did in the midst of an investigation in which Christian, in his role as legal counsel to the governor, played a central role. By moving forward with the nomination, confirmation and “private” swearing in last week, James said circumstances effectively “quashed” any subpoena power the Committe had to compel Christian to testify. The Legislature cannot subpoena a member of the Judicial branch.

Maybe they should have waited after all.

    WOW!!!! Where do we go from here? How can we proceed to get Mr. Adam Christian remove from the bench? Remember this is the same Judge who will be presiding over cases that will be dealing with persons whom maybe accused of perjury, fraud and etc…How would he be able to lead by example if he’s the one that’s setting bad precedents’? This is theatrically absurd and ludicrous.

    I like the first lady she comes from a good family. But if she did this thing with the lottery i think that she was just helping the children the governor is the one that did the wrong by telling Shelly in his letter to him that no government money was used. Maybe his wife don’t tell him what she is doing. Just like some one said on Jimmy show that the governor can’t tell her not to work for that sicko child rapist. The on problem I have with her is that she still works for him. But i still think that she is a lady. And maybe she will stand by her man when he goes to jail. I will always pray for her and her children.

    Lady deJongh is pretty and smart. The VI lottery should be commended for supporting the First Lady’s humanitarian efforts.

    CIF, please show a picture of the First Lady. No disrespect, the image of the majority leader and others whom you support are not attractive. Tell your photographer to to get better photos.

    Is it possible to see a bigger image of GOVERNOR deJongh? A great political leader should have a picture larger than life.In any event, CIF should be applauded for showing one of the best photo of deJongh.It is small, but he is smiling as if he won the grand prize. He does not look like a wolf to me. Why do you call him a wolf?

    I believe the Lottery was just giving to the children. The First Lady needs to show that all money donated was spent honorably and for the puposes intended.

    Its so sad that all those that come out in defense of the governor that post on this site are anonymous .. I cant stand deJongh first of all he lies to much ,drink too much , and most important doesnt know how to run a government . The Virgin Islands right now are chaosm including my office. And yes I voted for you in 2006 GOVERNOR. We cannot take more of this MESS . We try to give him suggestions they are never good enough for him Vote him out as soon as we get the chance. I know some people talk in favor of him to defend their jobs , but its sad those who defend the governor knowing all the bad things he have done. Not four more years of this … This is it for deJongh. Go back to doing what you did and leave us Virgin Islanders alone.

    “Crucianrican for deJongh” why don’t you try writing this in english now. It is really quite disturbing you can be here trying to asked us hispanics to vote on this Governor when everything he has done has in most part be for his personal gain. I am sure you are yet another person employed by this tyrant at what you consider to be a good salary and don’t give a darn about the Virgin Islands beind damage by this style of poor leadership. Any Governor could have negotiated giving away the house. It takes a good Governor to negotiate what was in the best interest of the people of the Virgin Islands. You really need take your head out of the sand and see what is really going on. You try to appeal to us hispanic and once again question our intelligence and I resent this. Most of us are a lot smarter than you give us credit for. We are prepared to make a prudent decision and make sure this tyrant does not return to public office. I have recently joined the Committee for Donastorg and we aready see the strategy for the Governor but it won’t work. It will be similar to the story of David (Senator Donastorg) and Goliath (Governor dejongh) and we sure know how this story concluded. The Primary Election race is on.

    Now they are saying Adam Christian did not attend the meeting. Why did they vote to accept the official transcrip with Christian name being included as attending? Their is so many interesting twist to this entire thing. But lets see what unravels.
