Transcripts confirm contradictions in Christian's sworn testimony to Legislature and PFA Records
On two separate occasions, under oath, newly ascended Superior Court Judge Adam Christian told the Legislature he did not attend the now infamous October 6, 2009 meeting of the Virgin Islands Public Finance Authority (PFA) where a resolution on funds appropriated 2 1/2 years ago was belatedly completed.
Transcripts from the meeting, however, say he was there.
The meeting was significant because it was at this session that $1.3 million in reprogrammed public funds from a March, 2007 Legislative action were approved. Those funds, from Act 6917, were authorized for road repairs but some of the money, some $490,000 documented to date, paid for renovations to Governor John P. deJongh’s private Estate Mafolie residence.
CIF has obtained a copy of the relevant portion of the Rules Committe transcript showing Christian’s dual denial that he attended the PFA meeting. A certified copy of the minutes from the PFA meeting, which list Christian as a “staff” member in attendance, was released at a Tuesday night Legislative Committee hearing investigating the Mafoliegate matter. Both documents are attached at the end of this article.
Tuesday’s hearing was convened by Senator Neville James, chairman of the Committe on Financial Services, Infrastructure and Community Affairs.
The PFA transcript also outlines the participation of the governor in the approval of the resolution containing the funds used in the renovation. The Governor is the Chairman of the PFA and several questions remain about the potential conflict of interest issues raised by the Governor signing contracts and participating in meeting transactions that enriched him personally through the unauthorized (by the Legislature) use of public funds at his private property.
The Committee had expressed a desire to question Christian during his confirmation hearings about these activities and his role in them as legal counsel to the Governor during the period between January, 2007 and the completion of the Mafolie renovation. Christian declined to answer questions from the committee during that session citing “attorney/client” privilege.
At that time, Sen. James said that he was uncomfortable with the “timing” of Christian’s nomination, coming as it did in the midst of an investigation in which Christian, in his role as legal counsel to the governor, played a central role. By moving forward with the nomination, confirmation and “private” swearing in last week, James said circumstances effectively “quashed” any subpoena power the Committe had to compel Christian to testify. The Legislature cannot subpoena a member of the Judicial branch.
Maybe they should have waited after all.

A letter by the stenographer was read by Mario. Does the Administration of CIF have it posted on this site? The letter verifies that Adam Christian was not present as he stated.

Hey we need to see the notes from the PFA board secretary Ms Gothlieb. She should have also written who was in attedance in her report.

The only thing that letter verifies is the amount of coruption that is being exposed, bit by bit, layer by layer.
Ask yourself this.
Why did it take the stenographer over 3 months to make the “correction” to her notes? When other minimal corrections like deleting “jr” from the end of someone’s name was made within days of the same meeting.
Now all of a sudden Adam Christian was not presentt at the meeting and the stenographer made a “mistake” by marking him present.
