PEOPLE OF THE VIRGIN ISLANDS WE ARE ABOUT TO GET “PLAYED” AGAIN IF SOMETHING IS NOT DONE TO ENSURE ADEQUATE PUBLIC NOTIFICATION BY THE PSC OF ITS PUBLIC HEARING ON ALPINE. THE VIRGIN ISLANDS COMMUNITY IS REQUIRED TO BE GIVEN THE PROPER NOTICE OF THE PSC ALPINE HEARING IN ACCORDANCE WITH LAW.

THE VIRGIN ISLANDS COMMUNITY WILL NEED AS MUCH HEALTH AND LIFE INSURANCE THAT THEY CAN GET IF THIS “SHELL” COMPANY DEALS ARE PERMITTED TO MOVE FORWARD. THE PEOPLE OF THE VIRGIN ISLANDS ARE NOT GETTING “ALL” OF THE INFORMATION ON THIS “ALPINE” DEAL AND THE TRUE HEALTH IMPACT WHICH WILL OCCUR AS A RESULT OF THE ALPINE PET COKE BURNING FACILITIES.

PEOPLE UNLESS YOU’RE IN A POSITION TO GET TRUTHFUL TIMELY INFORMATION YOU WILL NEVER KNOW ABOUT THE DANGER THAT IS LOOMING AT YOUR DOOR STEP. YOU SIMPLY WILL GET “PLAYED” RIGHT INTO HOSPITALS AND GRAVES.

The VI Code is clear on public notices of any “Public Hearings”. Users of this site or any other community member should not be trying to come up with ideas as to how to notify the community of this PSC hearing.

The PSC has clearly violated the rights of the community to adequate notice of at least 15 days in advance.

If the PSC move forward with its planned Alpine public hearing it will be doing so in violation of the VI Code.

§ 1. Public utilities subject to regulation; definition; financial interests of members of Commission

(a) The following services provided by an individual, firm, co-partnership, association, corporation or other person for compensation are declared to be affected with a public interest and are defined to be a public utility subject to this chapter, and the person providing such service to be a “public utility”.

§ 2. Just and reasonable rates and services

Every public utility doing business within the United States Virgin Islands is required to furnish service and facilities reasonably safe and adequate and in all respects just and reasonable. The charge made by any such public utility for any facility or services furnished, or rendered, or to be furnished, or rendered, shall be reasonable, just and nondiscriminatory. Every unjust or unreasonable or discriminatory charge for such facility or service is prohibited and is hereby declared unlawful. Every public utility is hereby required to obey the lawful orders of the Commission.

§ 22. Notice to utility of hearing

The Commission shall give the public utility and the complainant, if any, ten days’ notice of the time and place when and where such hearing and investigation will be held and such matters considered and determined. Both the public utility and the complainant shall be entitled to be heard and shall have process to enforce the attendance of witnesses.

General regulations on public hearings

(a) Public notice of any hearing as required by this subchapter, to be conducted by the Board of Land Use Appeals, or Planning Office, shall be deemed to have been given when the following actions have been completed:

1. A notice setting forth the general purpose of any such hearing and the time and place thereof shall have been published in a newspaper of substantial circulation in the area at least twice at intervals of not less than two (2) days; the first not more than fifteen (15) days nor less than ten (10) days, and the last not less than two (2) days before such hearing;

There is also no information or documentation relevant to the Alpine contract that the public can review prior to the hearings next week at any of these web sites. The public is being told by the PSC if they want to see documents relevant to its public hearing to come in its offices. Very strange in this era of modern technology that the information for public viewing is not posted to any of these websites.

Hugo Hodge made a statement on Roger Morgan show in late August 2009 that he was going to re post for public viewing the WAPA RFP that was used to select Alpine. Hugo Hodge did not re post the information as he said he would. What are these people trying to hide?

If public hearings are on Monday and Tuesday of next week. That does not give the community enough time to organize any protest at this meeting against Alpine.

If this is a hearing that the public is invited to how can the PSC make this statement?

“Time may be allotted for the public to offer comments during the hearing at the discretion of the Commission.”

This hearing sounds highly suspicious and fishy.
