James,%20NevilleWord has come to us that pressure is boiling in the Legislature’s kitchen. Senators Hill, Dowe and White appear to be furious that Senator Neville James posted the “Mafoliegate” documents on the Legislature’s website. As Senator James previously stated, the Governor’s actions are indefensible! It’s time for all Senators to accept this fact. It’s time to restore some integrity to the so called first branch of government. Senator, as Mario Moorehead would say, “your back broad.” Now prove it to your constituents. Push for a hearing. Stand firm!

    It seems like the rich has robbed the poor to enrich himself.This governor is surely going to need a GOOD lawyer now.All what has been said about this matter is really true.I have read all the documents that has been posted on (CIF),this is really interesting.knowing how the feds operate i don’t think that deWOLF has much time left. MY advice to him is start packing his boxes and go to KMART, pick up the biggest jar of VASOLINE, you will need it where you are going too.     They have not dleted the documents. I was just on there.

    There is something that I noticed was missing. Where is Koenig’s response to Smalls regarding the damaged/deteriorated fence? Senator James I hope you read this blog. Can we get that response uploaded if indeed it was given to you? If not, can you get it from either Mr. Smalls or Mr. Koenig?

    SNARKHAPPY YOU NEED TO CHECK AGAIN THE DOCUMENTS ARE NOT ON THE LEGISLATURE WEBSITE,FUTHER THE DOCUMENT YOU ARE REFERING TO WAS ON THE SITE UNTIL IT WAS DELETED.

    TITLE THREE Executive

    Chapter 33 Public Records; Fees

    § 881. Examination of public records

    Public records defined

    (a) When used in this chapter “public records” includes all records and documents of or belonging to this Territory or any branch of government in such Territory or any department, board, council or committee of any branch of government.

    Citizens right to examine

    (b) Every citizen of this Territory shall have the right to examine all public records and to copy such records, and the news media may publish such records, unless some other provision of the Code expressly limits such right or requires such records to be kept secret or confidential. The right to copy records shall include the right to make photographs or photographic copies while the records are in the possession of the lawful custodian of the records. All rights under this section are in addition to the right to obtain certified copies of records under section 882 herein.

    Enforcement of rights

    (e) The provisions of this chapter and all rights of citizens under this chapter may be enforced by mandamus or injunction whether or not any other remedy is also available.

    Penalty

    (f) It shall be unlawful for any person to deny or refuse any citizen of this Territory any right under this chapter, or to cause any such right to be denied or refused. Any person knowingly violating or attempting to violate any provision of this chapter shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than one hundred dollars.

    TITLE FOURTEEN Crimes

    Chapter 89 Records, Documents, and Reports

    § 1782. Mutilation and destruction of records by public officers

    Whoever, being an officer having the custody of any record, map or book or any paper or proceeding of any court, filed or deposited in any public office or placed in his hands for any purpose—

    (1) steals, willfully destroys, mutilates, defaces, alters, falsifies, removes or secretes the whole or any part of such record, map, book, paper or proceeding;

    or

    (2) permits any other person so to do—

    shall be fined not more than $2,000 or imprisoned not more than 10 years, or both, and shall be disqualified from holding any public office.

    I strongly suggest that Senator Neville James and his majority get together and appoint a special prosecutor or hearing examiner. I URGE THAT THEY LOOK AT jUDGE ROSS OR jUDGE KENDELL . IN LESS THAN A MONTH JUDGE KENDELL WILL BE OFF THE BENCH. WHAT ABOUT ATTORNEY JEFFERY MOOREHEEAD? JUST A FEW SUGGESTIONS.. IF ANYONE observe the budget hearing it is pain to see that this group has no idea how to follow up on questions. this whole darm thing is a pistacle

    Mafoliegate and the Ensuring Senate Hearing.

    We know what we SEE, and we know what we EXPECT of Senator N. James.

    We do not SEE him so much as the BROTHER of the St. Croix Administrator, hired by the Governor; but rather, we SEE him MORE as the SON of the GREAT Doc. James.

    We expect him to act not under the INFLUENCE of the HIRING of his brother; but rather, we expect him to act in accordance with the HISTORY and the LEGACY of his FATHER.

    As a student of History, Senator James knows he has no choice. He must Protect THE LEGACY, even if it means a full clash of “bare blades” with Hill, White, and Dowe.

    This Mafolie Matter is a Political Maker or a Political Breaker.

    Senator Neville James, in accordance with the VI Code, Title Three, Executive Chapter 33, Public Records; Fees, § 881. Examination of Public Records, the citizens of the Virgin Islands request to see the public records submitted to your committee by PFA Executive Director Julito Francis. We respectfully request to see ALL public records unless Mr. Francis violated your Subpoena Duces Tucum.

    Please inform the community as soon as possible so that this community can choose a course of action in accordance with the provisions of the VI CODE. One hundred dollars per citizen can become very expensive in a class action law suit. The community needs an immediate clear understanding on the status of the subpoenaed PFA records that are not posted at the 28th Legislature website.

    Senator N. James, where is the PFA public record attesting to its Board approval for the Authority to disburse public funds to pay for Governor John P. de Jongh VI government contracted work at his private estate?

    Shouldn’t there be a PFA record authorizing the use of public funds being that the governor is the Chairman of the PFA Board?

    VIRGIN ISLANDS CODE

    TITLE TWO, Legislature, Chapter 1, Investigations

    § 2. Testimony before Legislature or committees

    All officers and employees of the government of the Virgin Islands, and all other persons whether connected with the government of the Virgin Islands or not, shall appear and give and furnish to the Legislature or any of its committees, upon request, such information, records, and documents as the Legislature or any such committee may deem necessary or proper for the achievement of its legal and authorized purposes.

    § 6. Arrest for neglect or refusal to appear

    Whoever neglects or refuses to appear before the Legislature or any of its committees in obedience to subpoena may be arrested by a member of the territorial Police Force on the order of the Legislature or committee, and brought before the Legislature or committee. The only warrant or authority necessary to authorize the arrest shall be a copy of a resolution of the Legislature or committee signed by the presiding officer or the Chairman of the committee, as the case may be, and countersigned by the Legislative Secretary of the Legislature or a majority of the members of the committee, as the case may be.

    § 7. Refusal to testify or produce books, documents, etc.

    Whoever, having been summoned as a witness by the authority of the Legislature or any committee referred to in section 2 of this title, to give testimony or to produce books, documents, records, or papers upon any matter under inquiry or investigation before the Legislature or committee, willfully makes default or disobeys the subpoena, or, having appeared, refuses to be sworn, or to answer any question pertinent to the subject under inquiry or investigation, or to produce any of the books, documents, records, or papers, shall be guilty of contempt and shall be fined not more than $200 or imprisoned not more than 30 days, or both.

    § 8. Report of contempt; judicial compulsion

    (a) If the contempt referred to in section 7 of this title is committed before a committee during a session of the Legislature, the committee shall report the contempt to the Legislature for such action as may be deemed necessary by the Legislature.

    (b) If the contempt is committed before a committee when the Legislature is not in session, the District Court of the Virgin Islands may compel the attendance of the witnesses, the giving of testimony, and the production of books, papers, documents, and accounts, as required by the subpoena issued by the committee, on the filing by the committee of a petition to the court asking that the witness be so compelled.

    § 9. Proceedings for punishment of contempt

    Proceedings for the punishment of the contempt as provided for in this chapter shall be brought in the District Court of the Virgin Islands in the name of the Government of the United States Virgin Islands and shall be prosecuted by the United States attorney or his representative. In all such cases, the proceedings shall conform as near as may be to those prescribed by rules of court for contempts not committed in the immediate view and presence of the court.

    Sad to say but it’s true. Neville James is a fraud. He has the law on his side but have yet taken action to get “ALL” MAFOLIEGATE records from the de Jongh administration.

    By the way, Commissioner Darrly Small is in violation of the subpoena. Commissioner Smalls did not provide the records specifically for his department (DPW) work at MAFOLIEGATE. “DPW government employees man hours and work done at MAFOLIEGATE was not provide to the senate. This information is missing from the subpoena records. Commissioner Smalls during the August 24, 2009, DPW senate hearing also mentioned that DPW collect a fee for drive way constructions permits from the public. Where is the driveway construction permit for MAFOLIEGATE and who paid Darryl Small at DPW for the permit.

    Neville James is not going to bring the MAFOLIEGATE hearings. He is a part of the problem and has backed down to the de Jongh administration because they have goods on Senator Neville James.

    That’s a lie. The hearing is coming up soon. You guys need to chill and wait it’s going to be a very difficult time for this Virgin Islands, but we need to be patient.

    On Friday, August 28th, the New York Post published a question. Does anyone in the Virgin Islands know the answer???

    “WHICH political leader in the Caribbean is under investigation by the US government for using foreign aid to renovate his palatial home? The $443,000 spent was falsely listed as “security and road improvements.”

    Go figure!

    Can a governor be recalled for embarrassing his people before the entire free and democratic world?
